Terms & Conditions

Version 2026-09  ·  Effective September 2026  ·  These terms are incorporated by reference into every Custom Railz & Stairz quote and order.

1Agreement

These Terms and Conditions, together with the final approved Quote ("Quote") and the approved design drawings and 3D model ("Designs"), constitute the entire agreement ("Agreement") between Custom Railz & Stairz ("Company," "we," "us") and the client named on the Quote ("Client," "you"). This Agreement governs the design, fabrication, and installation of custom stairs, railings, and related products ("Products"). Pre-printed or standard terms contained in any Client purchase order, work order, addendum, subcontract form, or similar document shall not modify this Agreement unless expressly agreed to in a writing signed by both parties.

2Quotes and Orders

Quotes: All Quotes provided by the Company are valid for thirty (30) days from the date of issue. The Quote is based on the Designs and material selections agreed upon.

Order Confirmation: An order is considered confirmed upon the Company’s receipt of: (a) a signed copy of the final Quote by the Client; and (b) the required non-refundable deposit as specified in the “Payment Terms” section.

Acceptance: By approving the Designs, the Client acknowledges they have reviewed and approved all dimensions, materials, profiles, finishes, and hardware selections. Fabrication proceeds from the approved Designs.

3Design Services

3D Design & CAD Drawings: Provided within fourteen (14) days after deposit receipt.

Revisions: Three (3) standard revisions are included. Additional revisions are subject to a $200 fee per revision.

3D Model Access: The 3D model link remains active for ninety (90) days after activation.

Field Measurements: Final field measurements are taken after the order is confirmed. All quoted dimensions are approximate until final field measurements are taken.

4Payment Terms

Payment Schedule: A non-refundable deposit of sixty percent (60%) of the total quoted price is due upon agreement and commences the design and production process. Twenty-five percent (25%) is due upon material delivery. The remaining fifteen percent (15%) is due upon completion of the installation and in no event later than fifteen (15) days after completion. Delay in baluster installation is a courtesy extended for the finisher and does not delay the final payment.

Late Payments: Overdue balances are subject to a late fee of 1.5% per month (18% per annum) or the maximum rate permitted by law.

Lien Waivers: Upon written request, the Company will furnish a conditional waiver of lien with each payment received and a final waiver of lien upon receipt of final payment in full.

5Changes, Cancellations, and Returns

Custom Nature of Products: The Client acknowledges that all Products are custom-designed and custom-fabricated to their specific requirements.

Change Orders: Any changes requested by the Client after the order has been confirmed must be submitted in writing. Such changes may result in additional charges and may extend the project timeline. A formal Change Order document will be issued for Client approval.

Cancellations: If the Client cancels the order after confirmation, the 60% deposit is non-refundable to cover the costs of design work, materials, and labor already incurred.

No Returns or Refunds: Due to the custom-made nature of the Products, no returns, exchanges, or refunds are possible once production has begun.

6Lead Time and Installation

Lead Time: A standard lead time of four to six (4–6) weeks commences from the date the deposit is received. Due to the dynamic nature of the construction industry, please allow for a one to two-week fluctuation in the installation schedule. The Company is not liable for delays caused by factors beyond our control, including but not limited to supply chain disruptions, labor shortages, or delays caused by the Client or other contractors. The Company is responsible for delays caused by the Company.

Installation Notice: It is the Client’s responsibility to provide the Company with six (6) weeks’ notice prior to their readiness for installation.

Installation: The Client must provide clear and safe access to the property for our installation team. Once installation has begun, the Company will diligently pursue the installation to completion.

7Site Conditions and Client Responsibilities

Backing: The Client must provide adequate backing for all stair and rail installations. The Company is not responsible for backing, drywall, or finishing services.

Framing and Structure: Stair openings, framing, and subfloor are assumed to be reasonably level, plumb, and built to the dimensions reflected in the approved Designs. The Company is not responsible for correcting pre-existing structural issues, and additional charges may apply if significant shimming, scribing, or custom fitting is required due to out-of-square or out-of-dimension conditions.

Utilities: The Client must inform the Company of any hidden utilities (plumbing, electrical, etc.) within the installation area. The Company is not liable for damage to undisclosed utilities.

8Site Conduct and Damage

Conduct: The Company’s installation crew will maintain a clean and organized work area, dispose of waste materials properly, and conduct themselves in a professional and respectful manner at all times while on site.

Damage: The Company is responsible for damage to the Client’s property caused by the Company’s crew during installation, including damage to cabinets, fixtures, and flooring, subject to the Limitation of Liability section below. Any damage should be reported to the Company promptly.

9Insurance

The Company maintains Commercial General Liability insurance with a limit of $1,000,000 per occurrence, supplemented by a $3,000,000 umbrella policy, and Workers’ Compensation insurance as required by law. A certificate of insurance is available upon written request. For builder and general contractor clients, additional-insured status can be provided upon written request prior to installation.

10Finishing

All materials are delivered sanded and ready for the Client’s chosen finish. Finishing is not included in the Company’s scope of work. The finisher is responsible for filling nail holes with color-matched filler and for re-sanding the staircase or railing if it becomes dirty between installation and finishing.

11Warranty

One-Year Warranty: All materials are guaranteed as specified, and the Work will be performed professionally, completed for the agreed sum, and delivered within the discussed timeline, allowing for reasonable scheduling fluctuations as noted above. The Company warrants its Products against defects in materials and workmanship for one (1) year from the date of installation. This warranty is void if proper sealing of the wood is delayed by more than four (4) weeks post-installation.

Exclusions: This warranty does not cover: damage resulting from misuse, abuse, neglect, or improper cleaning; damage from excessive moisture or humidity; normal wear and tear, including minor scratches, dents, or fading over time; or Products that have been altered, modified, or repaired by anyone other than an authorized Company representative.

Claims: To make a warranty claim, please contact us with proof of purchase. The Company will acknowledge warranty claims within five (5) business days and will complete warranted repairs or replacements within a commercially reasonable time. Our sole obligation under this warranty is to repair or replace the defective component at our discretion.

12Materials and Hardwood Characteristics

Expect natural variations in color and grain. These are hallmarks of genuine hardwood; unusual or distinct grain patterns are not defects and are not grounds for replacement. Finish and stain samples provided are for general representation only; the final product may have slight variations in color and sheen.

13Photographs

The Company may photograph completed installations for portfolio, website, and marketing purposes. Photographs will not identify the project address, the Client, or the property owner without the Client’s separate written consent. The Client may decline photography of their project at any time by written notice to the Company.

14Limitation of Liability

The Company’s total liability under this Agreement, for any claim whatsoever, shall not exceed the total purchase price paid by the Client. In no event shall the Company be liable for any indirect, special, incidental, or consequential damages.

15Intellectual Property

All designs, drawings, 3D models, and renderings remain the property of the Company. They may not be reproduced or used without written consent.

16Legal Expenses

In the event of any legal action or arbitration arising from this Agreement, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and court costs from the other party.

17Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois. Any disputes arising from this Agreement shall be resolved in the courts of Cook County, Illinois. By signing the Quote or making a deposit payment, the Client agrees to be bound by these Terms and Conditions.
